Ah, yes, they have backtracked on their TOS.

Yes, the amended ToS are very different to those originally quoted. However, I think the above clause would still give them enough wriggle-room to sell ("distribute") image licences if they so desired. The people behind Instagram may be paragons of virtue but I wouldn't trust any of these web-based corporations as far as I can spit. Plus, in Instagram's case, since they are part of the Facebook empire they now have some very heavy corporate and banking shareholders pressurising them for profits and share value.

I still assert that there is nothing devious about what Instagram are doing. Displaying ads next to an uploaded photograph on a service that they own is not stealing anything.

Clicking on an ad just once a day will help me tremendously with financing this site.

There is a pending class action lawsuit against Facebook in the US for their own sponsored story system. The final outcome of that lawsuit could determine what instagram might do with their final terms about this. - This lawsuit apparently had been filed in 2011. I had no idea about it till I received an email containing its details because I may have been featured on a "sponsored story" on facebook apparently.

It's more insidious than that. While displaying an ad near your post of a picture is one example of what the new policy allows, other allowed uses go much further. It allows for example, Facebook reposting your photo in an ad, even if the copy of the ad is superimposed on your picture.

It's possible that Facebook could license a picture you took and posted with Instagram, outside of Facebook's ecosphere, and perhaps off the internet entirely (ie print media, but why would they do that!?) And you could get no money and no credit.
